We Can Establish That You Qualify For Veterans Disability Benefits
VA requires you to establish both of these things:
- You have a condition that affects your body or mind; and,
- You served active duty, active duty for training, or inactive duty training.
Also, you must prove one of the following:
- Your military service caused your condition, and you can link it to your service.
- You had a condition before joining the military, and your service made it worse.
- Your condition didn’t develop until after you left the military.
From here, if VA determines you qualify, it’ll assign a rating that reflects your disability. Your rating is a percentage from zero to 100. It determines what types of benefits (and how much) you receive.

Why Would My Application Get Denied?
VA may deny your application for many reasons. The American Homefront Project reports that, right now, the biggest reason is the Covid-19 pandemic. Even though stores are opening and the positivity rate is decreasing, many of VA’s offices remain closed.
In July 2020, over 1.5 million applications were backlogged, prompting reviewers to tear through as many applications as possible. This backlog sometimes resulted in unfair denials or long wait times.

Your Application Did Not Clearly Tie Your Condition to Your Military Service
You must have a service-related condition to qualify for benefits. To establish a link (or “nexus”), we will use your medical records and testimony from your doctor.
Your Application Contained Misinformation or Errors
Sometimes, it’s hard to remember when you began and ended your military service––especially if it happened decades ago. You may also unknowingly provide the wrong information.

Can I Lose VA Benefits After Getting Approved?
It is doubtful that VA will rescind your benefits after approval. However, it does happen. Periodically, VA will reexamine certain cases. If it suspects that you gave misleading information or made an error, it can reduce or deny benefits, per 38 CFR § 3.327.
If this happens, we will do everything possible to preserve your right to benefits. To protect your benefits, we may file an appeal or re-assert your condition’s severity.
